Builder Agreement

By submitting a listing on Brash, you agree to this agreement. Read it before you publish.
1. Who you are, who we are
You are a builder — an individual or company publishing AI agents on the Brash marketplace.
We are Brash, the operator of bebrash.co.
2. Your intellectual property
You own everything you create. Publishing on Brash does not transfer ownership of your agent to us.
By submitting a listing, you grant Brash a non-exclusive, worldwide, royalty-free license to:
- Display your listing (name, description, screenshots, demo video) on the platform and in marketing materials
- Distribute your packaged agent (the zip file) to buyers who purchase it
- Use your listing as an example of what's available on Brash
This license lasts as long as your listing is live. Buyers who already purchased retain their access if you remove your listing.
You also grant each buyer a perpetual, non-exclusive, non-transferable license to use the agent they purchased for their own personal or commercial purposes. Buyers cannot resell, redistribute, or sublicense your agent.
3. What you can publish
You can publish any AI agent that:
- You built or have the rights to distribute
- Works as described in your listing
- Does not contain malware, backdoors, or malicious code of any kind
- Does not violate intellectual property rights of third parties
- Complies with the terms of any third-party tools, frameworks, or APIs your agent uses
What you cannot publish
- Agents designed to cause harm, enable illegal activity, or deceive users
- Agents that are a repackage of another builder's work without permission
- Agents whose listings are misleading — if your listing says the agent does X, the agent must do X
- Placeholder listings with empty or non-functional packages
4. Revenue and payouts
Commission: Brash takes 20% of every sale. You receive 80%. Free listings ($0) earn no commission.
Minimum price for paid listings: $5.
Payout minimum: $20. Request a payout from your dashboard at any time once your balance reaches $20.
Payout method: bank transfer to the IBAN you provide in your account settings. Your balance accrues regardless — you won't lose earnings if you haven't set up your bank details yet.
Processing time: 2–5 business days after payout is requested.
Taxes: You are responsible for reporting and paying any taxes on your earnings. Brash does not withhold taxes on your behalf.
5. Updates and versioning
You can upload new versions of your agent at any time. Buyers who purchased within 1 year receive new versions for free and are notified by email. You cannot use version updates to fundamentally change what your agent does — that's a different product.
6. Reviews
Buyers can leave reviews after 24 hours from purchase. You can respond to reviews once per review, publicly. You cannot incentivize buyers to leave positive reviews, purchase your own agent to review it, or ask associates to do so. Review manipulation is grounds for immediate suspension.
7. Refunds
Buyers can request a refund within 7 days if the agent doesn't work as described. You have 5 business days to resolve the issue directly. If unresolved, Brash mediates and makes a final decision. If a refund is granted, your payout for that transaction is reversed. High refund rates (above 15% of total sales) may trigger a review of your listings.
8. Listing removal and account suspension
Brash may remove a listing or suspend your account for: malware or malicious code, misleading listings, content policy violations, repeated unresolved refunds, fraudulent activity, or legal requests.
For non-critical violations, we will give you 5 business days to fix the issue. For malware, illegal content, or fraud, we act immediately.
If we terminate your account, existing buyer purchases remain valid. Your full earned balance will be paid out regardless of the $20 minimum, within 10 business days of termination.
9. What Brash is not responsible for
- How buyers use your agent after download
- Third-party service interruptions (OpenAI API outages, etc.)
- Buyer's inability to deploy due to their own infrastructure issues
- Loss of earnings due to platform downtime
10. Changes to this agreement
We may update this agreement with at least 14 days' notice by email. Continuing to use the platform after that date means you accept the updated terms.
