Terms of Service

These terms apply to everyone who uses Brash — buyers and builders. The Builder Agreement adds additional terms for builders. If you're a builder, both apply.

1. What Brash is

Brash is a marketplace where builders sell AI agents and buyers purchase them. When you buy an agent on Brash, you're purchasing a downloadable package (a zip file) that you deploy on your own infrastructure. Brash facilitates the transaction — we are not a party to how you use the agent after download.

2. Your account

You must create an account to purchase or publish on Brash. When creating an account:

• You must provide accurate information
• You are responsible for keeping your password secure
• One person or entity per account — accounts are not transferable
• You must be 18 or older (or the legal age of majority in your jurisdiction)

You are responsible for all activity that happens under your account. If you believe your account has been compromised, contact us at support@bebrash.co.

3. Buying agents

What you get when you purchase

When you buy an agent on Brash, you receive:

• A downloadable zip file containing the agent and all files described in the listing
• Permanent access to re-download the version you purchased
• Free updates for 1 year from your purchase date (if the builder publishes new versions)
• A perpetual, non-exclusive, non-transferable license to use the agent for your personal or commercial purposes

What the license does not include

Your license to use a purchased agent does not include:

• Reselling the agent or offering it as a product for others to download
• Redistributing the agent (uploading it to other platforms, sharing the zip publicly)
• Sublicensing — you cannot grant others the right to use the agent as if they purchased it
• Removing or modifying any attribution or copyright notices in the package

You are buying the right to use the agent, not ownership of it. The builder retains all intellectual property.

Pricing and payment

Prices are listed in USD. Payment is processed by Stripe. By completing a purchase, you authorize the charge to your payment method. Free agents (price $0) are acquired through the same flow — you'll have a purchase record and the same re-download rights.

4. Reviews

You can leave one review per purchased agent, 24 hours after purchase. Reviews are public. Your review must be honest and based on your actual experience with the agent. You cannot:

• Leave fake reviews or reviews for agents you didn't genuinely use
• Leave reviews in exchange for compensation from the builder
• Use reviews to harass or make false claims about a builder

Brash may remove reviews that violate these rules. We do not remove reviews simply because they are negative.

5. Refunds

See the Refund Policy for full details. Summary: 7-day window, evidence required, Brash mediates. If a refund is granted, your download access is revoked.

6. What you cannot do on Brash

• Use the platform for illegal purposes
• Attempt to reverse engineer, copy, or resell any agent you purchase
• Scrape or systematically collect listings, pricing, or other platform data
• Create fake accounts or impersonate other users or builders
• Attempt to access systems or data you are not authorized to access
• Interfere with platform functionality or other users' experience

7. Content on the platform

Builders are responsible for their listings. Brash reviews listings before they go live but does not guarantee that every agent works as described. Reviews from verified purchasers are the primary signal of real-world performance.

Brash does not verify that agents work correctly. The quality gate checks coherence, safety, and completeness of packaging — not functional correctness. If an agent doesn't work as described, the refund and dispute process is the remedy.

8. Limitation of liability

Brash provides the marketplace infrastructure. We are not liable for:

• How agents perform on your infrastructure after download
• Downtime, data loss, or business interruption caused by using a purchased agent
• Actions taken by third-party services an agent connects to (OpenAI, etc.)
• Indirect, incidental, or consequential damages of any kind

Our total liability to you for any claim arising from use of the platform is limited to the amount you paid for the transaction in question.

9. Intellectual property

Brash's platform — the website, design, code, and branding — belongs to Brash. Builders' agents and content belong to their respective builders. Nothing in these terms transfers intellectual property between parties.

If you believe a listing infringes your intellectual property rights, contact us at support@bebrash.co with details.

10. Account termination

You can delete your account at any time. Your purchase history remains accessible for 30 days after deletion for record-keeping, then is deleted. Brash may suspend or terminate accounts that violate these terms. Purchased agents you've already downloaded remain yours to use under the license terms.

11. Changes to these terms

We may update these terms. When we do, we'll notify registered users by email at least 14 days before changes take effect. Continued use after that date constitutes acceptance.
